   As of June 20, 2026, the matter of the non-removed patent-pending and pre-copyrighted material on the google-ai-edge GitHub organization, the NVIDIA GitHub organization, the litert-community Hugging Face organization, and the NVIDIA Hugging Face organization is on the active federal criminal record at the Federal Bureau of Investigation through a complaint filed by GRUS LLC on the FBI Internet Crime Complaint Center (IC3):

   The IC3 submission enumerates the federal criminal statutes implicated and requests criminal investigation and platform-level action to compel immediate takedown of the named repositories.

   17 U.S.C. § 506 Willful infringement for commercial advantage is criminal copyright infringement.

   18 U.S.C. § 2318 Trafficking in counterfeit labels and false certifications of authority. Distribution of third-party-owned material under "open source" license is a false certification of authority.
   17 U.S.C. § 512(c)(3)(A) Formal DMCA takedown notices were transmitted on June 17, 2026 to Hugging Face Inc., GitHub Inc., and Microsoft Corporation across 33 departmental addresses.
   17 U.S.C. § 512(c)(1)(A) DMCA safe harbor is forfeited where the platform has actual knowledge and fails to act expeditiously. Both platforms hold actual knowledge as of June 17, 2026 and have not acted. The IC3 filing of June 20, 2026 places the safe harbor forfeiture on the federal criminal record.

The June 10, 2026 release of DiffusionGemma was a joint Alphabet + NVIDIA partnership release. Alphabet's own corporate blog post on the release states verbatim:

"Google worked with Nvidia to optimize the model across consumer RTX 5090 and 4090 cards (quantized), Hopper and Blackwell enterprise hardware using NVFP4 4-bit floating-point kernels, and deskside systems like DGX Spark and DGX Station."
This admission establishes joint partnership liability between Alphabet Inc. and NVIDIA Corporation for the unauthorized open-source distribution under the named repositories.
